breaking news, two fugitives on the run. a movie theater shooting that sent movie-goers scrambling over the weekend. why the security guard says he was justified opening fire on a threat. the election recount that is a full go in wisconsin and possibly two other states. a deeper look why knows conducting it are up against the clock. gym and new year's resolutions. >> don't push it. >> drizzle. the remnants of that system we went through over the weekend. we are seeing that move off to the east. don't be surprised by a little bit of a mist as you head out this morning. as we get a look at the bigger picture, there is rain further off to the east. a lot of moisture in the air and patchy fog in the north bay. temperaturewise, it is cool. upper 40s to low 50s with highs reaching to the upper 50s in san francisco. we'll take a close look at the microclimate forecast. mike has crashes in the east bay. >> a number are on the grid. no problems and no incidents. on the east bay, i'll focus on the one we can see with our camera in berkeley. there is a mist we can see with our camera.

a crash heading up toward university. we'll see the mist in the air. your commute direction westbound. two eastbound lanes are block getting over away from the bay bridge and heading to the richmond bridge a truck ran into the retaining wall. there is road work going on. breaking news right now we have been following this morning. police swarming a gilroy motel following up on a tip about the inmates who escaped from the santa clara main jail. a story we've been working the last couple of hours. >> bob redell, what are you seeing at the scene? >>. >> reporter: good morning. the hotel is behind me. the days inn here at murray avenue which until the past few minutes they did have this surrounded. we just put it into our

newsroom. they had it surrounded for a number of hours based on a tip one of those escaped inmates from last week, chavez could be staying inside the hotel. in the past few moments they did execute a search and did not find chavez. they did take one person, based on the video, it looks like it might have been a woman. they took this person into custody. the sheriff's office have been receiving numerous tips placing chavez in the gilroy area. at least one tip placed him here as recently as yesterday. they did not go into specifics what tip might have led them here to the days inn. this is what chavez looks like. we've got the mug shot of him and the other inmates still on the loose. he's on the left side of your screen with the vertical tattoo that runs above and below his left eye. on the right side is le ron campbell who is still on the loose. last wednesday night around

11:00, the sheriff's office says those two along with two other inmates cut through a second floor window of the main jail in downtown san jose and used a bed sheet to repel down the walls. the other two were caught right away. chavez and campbell outstanding. chavez has been in jail since august this year on charges including burglary, extortion, false imprison moment, resisting arrest, firearms violation. campbell has been in jail since february last year 2015. he's been held on charges, false imprisonment, criminal threats and firearms violation. sheriff's office received numerous tips about their location that placed them here in gilroy. live in gilroy, bob redell, today in the bay. 4:34 this morning, developing news, a scare from

movie-goers after gun shots sent people running for gofr. outside the brendan theaters in concord. a security guard shot a person following a disturbance that began inside the theater. police swarmed the building. some took cover in a storage room. >> scared to death. she was locked behind a door, but still. >> the victim shot suffered nonlife threatening injury. the guard believed he was armed. officers questioned the guard and closed the theater for the night. follow-up to a story we first broke on friday. support continuing to pour in for a south bay islamic center that received a threatening letter. it called for "children of satan" and said trump is going to cleanse america of muslims,

signed by americans for a better way. parishioners arrived to find this, flowers and notes willed with well wishes. two other mosques also received that threatening letter. we may find out if wisconsin can conclude its presidential election recount in time for the deadline which is december 13th. the green party is challenging election results in three states, wisconsin, michigan and pennsylvania. the clinton campaign is joining that effort. on twitter, trump is calling it a scam. >> this is a total and complete distraction and fraud. >> this is not about helping one guy and hurting another guy. this ises about providing a system that we the voters can believe in. >> column claimed on twitter he won the popular vote and not hillary clinton. that's because trump alleges millions of people voted

monday morning. the time is 4:40. we get a live look outside of san jose. a few clouds, mist and drizzle. expect it to reach into the low to mid 60s with a lot of clouds. i'll talk about the clouds and clearing in the forecast coming up. we are looking at a smooth drive as far as this is concerned. westbound 24, tracking one crash

there. no delays on the span. san mateo sheriff's deputy is recovering after being injured during a drug smuggling bust. u.s. coast guard officials notified about three drug suspects trying to smuggle drugs into the park. san mateo deputies assisted in the bust. the boats are often used by suspected drug smugglers. the deputy was injured, but details how it happened aren't being revealed. the deputy is expected to be okay. all too familiar situation in san jose state. university fired its football coach. head coach is out after four years as the spartans' leader. he did not have a winning season and finishes his time with the

you're looking at the scene 4:00 this morning as police swarmed a gilroy motel. this followed a series of tips about inmate whose escaped from the santa clara county main jail on the eve of thanksgiving. they've been on the run entering their fifth day. police learned there was reason to believe they could be at this gilroy motel. they moved in but did not find signs of either escaped inmates. very active hunt for those two fugitives. 4:45 on your monday morning. drizzly start out there. >> soggy. this weekend was wet. yesterday we had a break. now we see that moisture return. as we get a live look outside at oakland, you can't see too much and you may need to turn on the windshield wipers.

it's 51 in oakland. reaching 57 for the high today. the weather system that moves through the weekend is kind of brought back round up wet weather for the sierra. for us, it's still cloudy. also mist and drizzle. in napa, the visible down to about 2 1/2 miles. half moon bay 1 1/4 miles. now it's 49 in livermore. 51 in oakland. san francisco and napa as well as san jose. with highs today reaching upper 50s to lower 60s. still cool. you'll need long sleeves all throughout the day. livermore, it's now 49 heading up to 59. we see this trend of slowly going up and a lot of clouds throughout the day. we will get clearing as we go through this evening. here is the way it pans out. the hour by hour outlook shows we will have quite a few cloud. then as we go into tonight,

mostly clear and chilly temperatures. sunshine tomorrow. by wednesday, some clouds start to move in early and spotty rain during the afternoon. doesn't look like a lot of rain though. san francisco looking at highs in the upper 50s through the rest of the week. once again a chance of light rain on wednesday. we'll see the same thing for the inland areas. a little milder and check out the weekend. already making plans to get outside. it will be in the mid 60s with mostly sunny skies. heading to mike starting with a crash in hayward. >> we have a number of crashes. first one off the nimitz freeway. no incidents and no slowing. there is no slowing, but there is a crash northbound 880 as you get toward 80 street. two lanes are still blocked off to the right. four lanes are getting by. they are moving smoothly up to 238. another set of crashes here, 24 at fish ranch road.
